What is the scope of the Flim Terms of Use?

These General Conditions of Use govern your legal relationship with SAS Flim, a company registered in Paris, France, under number 887 670 966. By using the Search Engine, accessing the technological tools, or purchasing a subscription, you fully accept these conditions for the entire duration of your use. You confirm that you have the required capacity to contract and utilize these services. These terms are accessible at all times on the website and prevail over any other document. Flim reserves the right to modify these conditions at any time, and your continued use signifies acceptance of the updated terms.

What is the purpose of the Flim service?

Flim provides a curated Search Engine that gives you access to a vast library of images and video sequences extracted from films, documentaries, commercials, music videos, and television series. These assets serve exclusively as visual references to help you research, find inspiration, establish aesthetic direction, and build professional or educational pitch presentations, such as moodboards, during your pre-production phase.

What are the strict limitations on asset usage?

You are authorized to use Flim assets for internal reference and private pre-production workflows only. Any service that directly competes with Flim is not considered internal use.

  • You are strictly prohibited from reproducing, distributing, public broadcasting, reselling, or transferring any image or video file, whether for a fee or free of charge.

  • You may not use assets for commercial campaigns, public advertising, entertainment purposes, or end-product layouts.

  • Flim does not own the copyrights to the indexed cinematic material and cannot grant commercial licenses. Legal liability for any unauthorized public display rests entirely with you.

  • Using any asset, metadata layer, or generated output from Flim to train, feed, or optimize external artificial intelligence models or machine learning algorithms is completely forbidden.

Violating these terms will result in the immediate restriction, suspension, or permanent termination of your account without notice or compensation.

What are the rules for managing your account?

When you register, you must provide complete, accurate, and truthful information, keeping your details updated at all times.

  • You are permitted to create only one account.

  • You may not open a new account if your previous profile was terminated by Flim.

  • You are entirely responsible for maintaining the confidentiality of your credentials, including your username and password.

  • You are responsible for all activities that occur through your account.

  • Account sharing is strictly prohibited. You must never use another person's account or allow someone else to access yours.

How do subscription plans and automatic renewals work?

You can select a monthly or annual subscription tier that best matches your workflow requirements. Subscriptions are strictly individual and personal. For Team Plans, every individual colleague must hold their own dedicated license seat.

Your initial subscription period is defined during checkout and automatically renews for identical durations. You can deactivate the automatic renewal at any time by updating your billing preferences inside your account settings. Flim reserves the right to revise the pricing structure at any time by updating the website or sending an email notification.

What are the billing and payment terms?

By subscribing, you agree to recurring billing cycles calculated from your initial registration date and billed on each monthly or annual anniversary.

  • Taxes: All listed prices exclude VAT. A standard VAT rate applies to individual accounts globally and to all professionals located in France, subject to specific bilateral agreements.

  • Late Payments: Late or failed payments automatically incur interest penalties calculated at the monthly refinancing rate of the European Central Bank plus 10 points, alongside a fixed collection indemnity of 40 euros per invoice. Late payments trigger the immediate demand for all outstanding balances.

  • Payment Processing: By entering your credit card details, you authorize Flim to charge your account securely via a third-party payment processor, such as Stripe. You are required to keep your billing information up to date.

What are Beta services?

Flim may invite you to test upcoming tools and experimental features before they are released to the general public. These Beta services are provided for evaluation purposes only, remain subject to the standard Terms of Use, and can be modified, restricted, or discontinued at any time at the sole discretion of the platform.

How does Flim handle data retention and privacy?

Flim requires access to specific personal details, such as your name and email address, to process your subscription and guarantee secure account access. Your personal data is managed in strict compliance with the French Data Protection Act and European GDPR regulations. You maintain a permanent legal right to access, rectify, limit, transfer, or request the deletion of your personal data by contacting [email protected] with "Individual rights request" in the subject line.

Flim retains your information for the duration of your active account use or as required to meet legal obligations, resolve disputes, and maintain system integrity. Data used for promotional communications is stored for a maximum of three years after your last interaction, unless you opt out earlier.

What are the intellectual property boundaries of the website?

With the exception of the indexed third-party film frames and video sequences, Flim owns all elements of the platform. This includes the underlying software, algorithms, user interfaces, text, graphics, layout, and computer code, which are protected by international copyright and trademark laws. No portion of the website architecture or its curated infrastructure may be copied, reproduced, displayed, encoded, translated, or distributed to any other server or medium without explicit written consent.

What are the limitations of Flim's liability?

Flim is provided on an "as is" and "as available" basis, without any warranties of merchantability, uninterrupted access, or complete error-free operation. The library content is compiled via an automated indexing process without systematic manual pre-screening. Flim is not responsible for the accuracy of search results or the content of external third-party links.

To the maximum extent permitted by law, Flim is only liable for direct harm caused by intentional misconduct. Flim excludes all liability for indirect damages, loss of profits, data corruption, or missed business opportunities. Financial liability is strictly limited to the exact amounts you paid for your subscription during the six months preceding the event. If you use a free account, your sole remedy is to stop using the platform.

Which law governs this agreement?

This service agreement is governed exclusively by French law. Any legal dispute, claim, or litigation arising from the use of the platform falls under the exclusive jurisdiction of the courts of Paris, France.

Which language version is authentic?

These terms are originally drafted in English. In the event of an inconsistency, contradiction, or conflict across translated versions, the English text is the sole authentic version used to settle disputes.
